Exactly what criminal charge(s) is he trying to avoid?

A criminal charge is only an accusation so he could have chosen to defend himself.

What's the difference anyway?

If found not guilty then no more deportation.

If found guilty then deportation is in order, which is exactly what he volunteered for anyway.

Well....

if convicted he would have to serve his sentence in the US prior to deportation to Haiti.

May be he believes that he doesn't have a chance at a legal defense.
